Complex commercial frauds often involve an intricate web of connecting individuals and entities. Third parties, such as bankers, brokers, lawyers and auditors may play a role in allowing such activities to take place or continue undetected and, as a result, may be exposed to liability to the victims. In recognition of this reality, Canadian common law has developed various means by which those third parties may be held accountable for their involvement with the fraud. This seminar will explore this area of the law and will also look at the decision of Castor Holdings in this context.
