Blair Yorke-Slader comments in The Lawyer’s Daily on the Court of Queen’s Bench of Alberta awarding more than $1.3 billion to Dow Chemical Canada ULC and an affiliate in a claim against NOVA Chemicals Corporation for conversion and breaches of contract arising out of the parties’ co-ownership of an ethylene faculty in Alberta. Bennett Jones acted as lead counsel for Dow.
The Lawyer’s Daily reports that:
“Despite the complexity of the 12 contracts between Dow and Nova involved and the science surrounding the engineering and chemistry of the production of ethylene, Yorke-Slader said the case “was not that complicated in its essence.” He said the main takeaway is that contracts, no matter how complicated their language or subject matter, will be interpreted to “mean what they say.”"
