Overview
Tyler McDonough has a commercial litigation practice with a focus on energy and natural resource disputes. Tyler acts for clients in a broad range of corporate commercial matters and represents clients in complex large-scale disputes. In addition to his commercial litigation practice, Tyler has experience in the law of policing and professional negligence.
Tyler has assisted with matters before the Alberta Court of Justice, the Alberta Court of King's Bench, the Alberta Court of Appeal and the Supreme Court of Canada, as well as numerous administrative tribunals.
In his spare time, Tyler enjoys travelling, spending time outside and running marathons.
Client Work
Representing the landlord in a successful claim for breach of lease against a tenant who had leased an entire 37 story office building and then vacated it with 12 years left on the lease, claiming that a minute amount of hazardous materials in building materials from decades earlier justified that decision. Pursuing a complex action on behalf of several mining companies claiming the Government of Alberta’s policy decision resulted in the de facto expropriation of their mineral freehold and leasehold rights, which has included successfully compelling a former provincial cabinet minister to attend for questioning: Cabin Ridge Project Limited v Alberta, 2025 ABCA 53 (leave to appeal to Supreme Court of Canada dismissed, 2025 CanLII 33162)
Representing the Chief of Police of the Calgary Police Service in many proceedings involving member discipline, fatality inquiries, and general litigation, including: Cheever v Alberta (Law Enforcement Review Board), 2022 ABCA 152, Su & Huang v Calgary (Police Service), 2024 ABLERB 01, and Barton v Calgary (Police Service), 2022 ABLERB 15
Successful in application for summary dismissal of claim for professional negligence: Van Grinsven v Kortbeek, 2022 ABQB 138
Successfully opposed application for summary judgment on behalf of a developer in a multimillion-dollar pre-construction condominium dispute: Schmidt Family Trust v Hon Towers Ltd., 2020 ABQB 150
