The panel discussed the intersection of insolvency law and real estate development and construction law, issues related to liens and lien consolidation orders, trusts and breaches of trust, priority charges, the differences in acting for developers, general contractors and sub-contractors, cash-flows and how they are impacted by holdbacks, factoring receivables, staying guarantees and releasing guarantors.
