Gavin Finlayson presents on the types of insolvency or insolvent events and the 2009 Amendments to the Bankruptcy Act and the Companies’ Creditors Arrangement Act in the context of intellectual property. Problems and gaps in the Amendments are identified with a comparison of the Canadian situation and the U.S, position. Also addressed are the legacy of the Body Blue and YBCI cases and offered solutions to protect IP licensees from termination.
